For us, protection of our users and our customers’ personal data is a key concern. All personal data collected from users are used for market research and opinion polling, and also contribute to improving products and services of various companies and clients.

1. Basic Principles in Processing User Personal Data

Vecara acts as responsible party according to BDSG.

2. Personal Data

Personal data are deemed to include individual information on the personal or factual circumstances of a physical person. Among these are e.g. your name, date of birth, sex, postal address, phone number, email address, identification numbers and, in certain cases, your opinions or personal preferences.

3. Collecting and Processing Data

Within the framework of services provided, the operator of Tell’em box collects and processes personal user data, in detail: name, age, sex, range of income and email address. All these data are given on a voluntary basis only.

Furthermore, any user information is collected and stored which users provide within their messages.

When using our app, the device ID number of the user’s mobile device is collected and processed, as is his location information. Collecting and processing user location data are mandatory prerequisites to install the app. Users may block access to his location data after installation at any time by changing their mobile device’s settings. In this case users must input the address data of any company or client manually regarding whom they want to send in a message.

Within the services provided, operator collects the following personal data from its customers, i.e. companies and public institutions which utilize Tell’em box for improving their respective products and services: name of contact person, address, email address and phone number. Reporting these data is mandatory for all customers wanting to use Tell’em box services.

4. Contacting

If contact is established (e.g. through our contact form or by email), user information is saved in order to process the inquiry and to forward existing additional questions, if applicable.

5. Disclosure of Personal Data

Personal data are collected exclusively for purposes of market research and opinion polls. We transmit all user data in anonymized format to clients so as to ensure no personal references can be established anymore. This applies particularly to device IDs of user mobile end devices.

Only if user expressly accepts disclosure of their name and/or location data towards client will user information be connected with their name and/or location information.

You may revoke your consent to the disclosure of your name and/or location data for the above purpose at any time. 6. Cookie Use on the Web Site

We use cookies. Cookies are small data sets which are stored on the computer of any user who accesses certain web sites. Cookies enable the web server to retrieve user-specific information which serve to facilitate and render more comfortable user’s web site experience, or without which certain functions do not work at all.

7. Log Files of the Web Site

Whenever users access the web site their access data are stored on the server. Access data include: name of the web site accessed, file, date and time of access, amount of transferred data, announcement of successful download, browser type, user operating system, the web site visited previously, IP address and the respective provider. The web site uses these logs in anonymized form for statistical purposes, which means no assigning data to specific users or obtaining information on same are possible. We reserve the right, however, to check such log files later in case specific evidence indicates that an illegal use of the web site may have taken place.

8. „Google Analytics

This web site uses Google Analytics, a web analysis service by Google Inc. („Google“). Google Analytics uses so-called „Cookies“, which are text files stored on your computer that permit an analysis of your use of the web site. Any information on your use of the web site generated by this cookie is usually transmitted to a Google server in the US and stored there.

In case IP anonymizing is activated on this web site, however, your IP address will be abbreviated before being saved by Google within EU member states or within other member states of the EEA Treaty. Only in exceptional cases will Google transmit the entire IP address to one of their US servers to be abbreviated there. To ensure anonymous capturing of IP addresses, Google Analytics was enhanced with the code „gat._anonymizeIp();“ to determine that IP addresses may be processed in abbreviated form only, and thus to exclude any possibility of direct, individual identification.“

9. Newsletter

You are offered the option to sign in for our free newsletter. Signing in requires stating your email address. This newsletter appears in irregular intervals and informs reader on current offers by Vecara GmbH and Tell´em box, giving interesting tips on customer loyalty management, data analyses and exciting case studies. For distributing our newsletter we use the so-called Double Opt-In process, i.e. after submitting the registration form you will first receive our confirmation email message. We will use your email address for sending out the newsletter only after you have clicked on the link within our confirmation email.

Registering for our newsletter also constitutes submitting the following Declaration of Consent, which we print here for information purposes:

10. Embedding SocialPlugins

By using the usual SocialPlugins by Facebook, Twitter etc., individual social networks are able to collect detailed information on user surfing behavior (so-called User Tracking): when accessing a web site with integrated plug-in, the user’s browser builds up a direct connection to the servers of the respective social network. This results in user data such as, above all, the IP address being transmitted to the network, so that the network receives information that this user has visited the web site concerned. If user is simultaneously logged into this social network, the latter is able to link the web site visit with the user’s account. Users who want to prevent this need to log out from their social networks before visiting web sites using integrated SocialPlugins.

But even in cases where the user is not a member of a particular network, data transmission to the network takes place if the usual SocialPlugins are integrated in the web site. With web sites integrating an active SocialPlugin, every user accessing the web site will receive a cookie. This cookie is automatically sent along with every new connection to any server of the network, which permits the network, in principle, to gather all web sites the user has visited and to generate a particular profile from this data. It cannot be excluded, therefore, that such data stored at the respective network are matched to an individual, if this individual later on signs into this particular social network.

Since numerous networks have their company seat outside of Europe, e.g. in the US user’s data will be transmitted to social networks in third countries such as the USA, in the cases described above.

We want to offer you the option to show your interests to your social network contacts – provided you agree to data transmission to the respective network. Consequently, to protect your data we use, as a standard, the c’t project Shariff developed by magazine publisher Heise. With Shariff you may use Tell’em box without exposing your entire surfing behavior to social networks.

The Shariff button blocks connections to social networks unless you yourself become active and click the button. Only then will your user data be transmitted to the respective US-based network or to other third countries and, as the case may be, may be stored there as described above. 11. Right of Information

You are entitled, at any time, to receive information on all data stored concerning yourself, on their origin and the purpose of processing such data. Users also have the right to have any incorrect data corrected and to restrict access to, or even delete, their own data.

12. Right of Withdrawal

You have the right to withdraw your consent to the processing and use of your data with future effect. Unless there is a justified exception due to abuse or because of any statutory storage requirements, we shall then delete all your data immediately and completely.

13. Correction, Blocking, Deletion

You have the right to demand correction, blocking or deletion of your personal data at any time.
